#Massive Win For AAP : Delhi Chief Minister Arvind Kejriwal, Hails Supreme Court Verdict; Other Leaders Hit Out At BJP

In a unanimous verdict, the Supreme Court ruled on Thursday that the Delhi government has legislative and executive powers over services. This is big win for Delhi Chief Minister Arvind Kejriwal and AAP party. And a major embarrassing moment for BJP .

Supreme Court said States too have the power but the executive power of the State will be subject to the law existing of the Union. It has to be ensured that the governance of States is not taken over by the Union .

The AAP soon after  hailed the Supreme Court’s verdict on the Centre-Delhi services with party chief and Delhi Chief Minister Arvind Kejriwal terming the verdict a “victory of democracy”.

This is a judgement in favour of the people of Delhi and I welcome every legal count of it. We hope and trust that all such over adventurous legal acrobatics as practised by the Central govt in the NCT case will not reoccur: Senior advocate Abhishek Manu Singhvi, representing Delhi govt in the case vs LG told ANI.

Earlier delivering the verdict, the Supreme Court rules in favour of the Delhi government over control on administrative services in the national capital and holds that it must have control over bureaucrats transfer postings.

SC holds legislative power over services exclude public order, police and land.

Supreme Court says in a democratic form of government, the real power of administration must rest with the elected government. If a democratically elected government is not given the power to control the officers, the principle of the triple chain of accountability will be redundant.

SC further said Delhi government is selected by the electorate of Delhi and must be interpreted to further cause of representative democracy.

Supreme Court says if the officers stop reporting to the ministers or do not abide by their directions, the principle of collective responsibility is affected. The officers feel they are insulated from the control of the government, which will dilute accountability and affect governance

CJI says we are unable to agree with Justice Ashok Bhushan in the split judgement of 2019.

Post SC ruling the LG except Land, Law and order and police has to now abide by the decision taken by  the elected government.

Taking a dig at the BJP, AAP on Thursday termed the Supreme Court’s verdict on the Centre-Delhi services row a “tight slap” in it’s  mission to topple governments through “unconstitutional ways”.
